Democrats and the media sense momentum on their side following a border patrol agent shooting an armed agitator in Minneapolis who violently resisted arrest.

Government funding was set to run out, and Schumer led a charge by Democrats to shut the government down to force Trump to surrender and accept demands to cripple ICE and end mass deportations.

POLITICO reported that Schumer’s demands “include requiring judicial warrants for immigration arrests, overruling a recently disclosed ICE memo asserting they are not required. Other potential Democratic amendments would mandate federal agents identify themselves, require DHS to cooperate with state and local investigations, and limit the mission creep of federal agencies.”

Fox News correspondent Bill Melugin pointed out that Democrats’ demand for federal judicial warrants for ICE agents to arrest illegal aliens would end mass deportations.

“If reports are true that Dems are demanding judicial warrants for all ICE arrests as part of the DHS funding bill, that will take a massive amount of targets off the board for ICE. They would only be able to go after illegal immigrants who have committed a new *federal* crime *after* entering the U.S. illegally,” Melugin wrote on X.

Melugin explained that requiring a federal judicial warrant means ICE wouldn’t be able to arrest illegal aliens arrested for state and local crimes, even for serious offenses like DUI, where a drunk illegal alien driver injures an American citizen.

“For instance, if an illegal immigrant gets arrested in Minnesota for a DUI crash causing great bodily injury (state crime) and bonds out of jail, ICE would not be able to target him for arrest because there would be no judicial warrant (not a federal crime),” Melugin added.

A federal judicial warrant requirement for ICE to arrest illegal aliens means living illegally in America is no longer grounds for deportation.

Illegal aliens could put down stakes and freely live in the country, suck up welfare benefits, and commit crimes as long as they weren’t federal offenses,s and ICE would be powerless to remove them.

“ICE would not be able to target anyone for just being in the U.S. illegally. They would have to wait for a federal crime to be committed, then a federal judge would have to sign off on probable cause for arrest,” Melugin continued.

The current standard is that ICE needs to show probable cause that an illegal is eligible for deportation and use civil administrative warrants to detain them.

“Warrants are *not* required for ICE arrests under US law right now. They simply need probable cause that the target is detainable/deportable on immigration grounds and use I-200 and I-205 civil administrative warrants,” Melugin remarked.

Melugin said sources within ICE told him that requiring a federal judicial warrant for illegal alien arrests means deportations would plunge to near zero.

“One ICE contact in a sanctuary city tells me: “If we need a judicial warrant for every arrest, we would maybe have 15 arrests in a year.” (In his city),” Melugin concluded.
