The media and Democrats spent years insisting it never happens.

Now there is a man in handcuffs, and the White House is not letting anyone forget who said what.

And the first arrest in what First Assistant US Attorney Bill Essayli calls a broader election fraud crackdown has the critics scrambling for cover.

The Arrest Democrats Said Was Impossible

Federal prosecutors in Los Angeles recently charged Darwin Jonathan Rivera Flores, 30, of Winnetka, California, with two felonies: fraudulent voter registration and false claim of US citizenship.

Rivera Flores is a Honduran national and lawful permanent resident. He entered the United States in 2002 and holds a green card. That status does not make him eligible to vote. But according to the Department of Justice, he checked a box on a voter registration application declaring himself a US citizen anyway, signed it under penalty of perjury, and submitted it to the California Secretary of State.

The registration application deadline was dated November 4, 2025. The birthplace listed under his name read “United States of America.”

Prosecutors noted that Rivera Flores did not cast a ballot in an election. The registration itself is the crime. And it is a serious one. He faces potential prison time and deportation if convicted.

But the charges do not end with the voter registration. Rivera Flores was previously charged with a misdemeanor for allegedly disrupting immigration law enforcement operations at a federal building in Camarillo, California, and received a one-year probation sentence. He also allegedly sent a Homeland Security Investigations agent a string of taunting text messages, calling the officer “not the good guy” and saying he could not “wait until the midterms” because he believed the agent would not have qualified immunity.

That is not the profile of someone who stumbled into a paperwork error.

Essayli and Dhillon Serve Notice on California

First Assistant US Attorney Bill Essayli for the Central District of California announced the arrest and made clear this is not a one-off prosecution.

“Today’s arrest is the first of many to come,” Essayli said. “Unfortunately, because states like California allow non-citizens to easily register to vote and receive a ballot by mail, there’s no telling how many non-citizens are currently registered to vote.”

He went further, renewing the DOJ’s standing demand that California open its voter rolls to a federal audit. “We again renew our request that California immediately comply with our requests to audit their voter rolls so that all voters can have confidence in our elections,” Essayli said.

Assistant Attorney General Harmeet Dhillon of the Justice Department’s Civil Rights Division added her own statement. “Noncitizens who commit fraud so they can vote in American elections do so in violation of federal law and should expect to be prosecuted,” Dhillon said. “Let this criminal complaint serve as a reminder that the Justice Department stands ready to enforce the laws Congress enacted to ensure only American citizens vote in federal elections.”

California has refused to comply with the DOJ’s request for an unredacted statewide voter file. Governor Gavin Newsom has continued fighting the Trump administration’s election oversight efforts in court. Fox News Digital reached out to Newsom for comment on the Rivera Flores arrest.

Essayli’s office confirmed it is working with Dhillon on the voter roll audit, a matter currently pending before the Ninth Circuit Court of Appeals. So the legal fight between Sacramento and Washington, DC is not close to finished.

The White House Takes the Victory Lap It Earned

The White House did not miss the moment.

White House spokeswoman Lauren Bis told Fox News Digital that the Rivera Flores case proves the media and Democrats have been wrong all along. “Despite the media and Democrats claiming it never happens, the evidence of noncitizens registering to vote in our elections continues to pile up,” Bis said.

“Any non-citizens found registering to vote and voting in our elections will be held accountable. Only Americans should be electing American leaders.”

That is a direct shot at years of dismissals from the press and the political Left, and it lands with some force right now because the evidence is no longer theoretical.

The New Jersey situation made this moment inevitable. Weeks before the Rivera Flores arrest, New Jersey disclosed that a software error by vendor IDEMIA improperly registered roughly 6,600 noncitizens to vote, and that fewer than 400 of them cast ballots. CNN and SiriusXM host Michael Smerconish acknowledged on his program that he could no longer claim noncitizen voting never occurred. “I can’t say that any longer,” Smerconish said. “I don’t know how often it does happen, but I can’t say any longer, ‘This never happens.'”

That admission was striking. Smerconish said he had previously reached the opposite conclusion after discussing a New York Times analysis that found no evidence of widespread fraud. But the New Jersey numbers forced a reconsideration.

And now California has produced a federal arrest, with Essayli promising more to come.

What the Critics Got Wrong and What Comes Next

For years, anyone who raised concerns about noncitizen voter registration got the same treatment: accused of trafficking in debunked conspiracy theories, of stoking fear without evidence, of undermining confidence in elections for political gain.

The SAVE Act, which would require proof of citizenship to register to vote in federal elections, was attacked by Democrats as voter suppression. The same critics who called the problem imaginary also fought the most commonsense tools for addressing it.

But the evidence keeps accumulating. A Department of Homeland Security review of state voter rolls and public records identified approximately 278,000 noncitizens registered to vote in federal elections. The White House has noted that because Democrat-controlled states refused to share their voter files, the real number is almost certainly higher.

California sits at the center of this problem. State law allows noncitizens to obtain driver’s licenses, and automatic voter registration systems have created documented pathways for noncitizens to end up on the rolls. Essayli has been direct about what that means: with no audit, there is no way to know how many Rivera Flores-style cases are sitting undetected in the voter file right now.

The argument that noncitizen voting is a myth used to be a conversation-stopper. It no longer works that way. New Jersey proved the infrastructure for it exists. California just produced the first federal arrest. And Essayli made clear the prosecutions are not stopping with one case.

Democrats who built their election-integrity talking points around the claim that this never happens are now in an uncomfortable position. They can either acknowledge the problem and work with the DOJ on audits and enforcement, or they can keep fighting the voter roll review in court while more arrests come out of Essayli’s office.

The voters who sent President Trump back to Washington, DC in 2024 did so with a clear mandate on election integrity. The SAVE Act, the DOJ’s push for voter roll audits, and the prosecution of illegal aliens who fraudulently register to vote are all part of delivering on that mandate.

Only Americans should be deciding American elections. That is not a radical position. It is the law. And the Justice Department is now enforcing it.
